It doesn’t matter. If an ISP can choke off access, my idea is worthless.
What do you think Google, Apple, IBM, and Microsoft have done for ages? They choke off ideas by either buying them, suing them, or creating a product/service to compete against them. Ford has done it, GM has done it too... its called barriers to entry. If it's a great idea and you get the funding you need and the market timing is right you'll be fine... just like in EVERY other industry in the US.
When did Facebook start up? BEFORE NET NEUTRALITY? What about Google, Twitter, Groupon, Zillow, Amazon, Reddit, Match.com, Pandora, Wikileaks, ebay, craigslist, youtube, linkedin, dropbox, etc.... OMG!!! HOW COULD THAT HAPPEN?!?!?!
