Here.  This will certainly allow you and BL to say "That's not right!!!  We gotta protest on a simsports message board" but this is it:

So I read this. And I don't disagree with much if any of that. Your response is "this is how it is, oh well." Is that your response to most thing you disagree with?

It's also an article regarding the non-indictment of Wilson, which I actually agree with. Some of that doesn't apply to Garner's case. The part that does, is the conflict of interest with the DA and the NYPD. When you rely on the NYPD for the vast majority of cases, you don't want to **** them off by indicting a cop. And your response is essentially "yup. That's how it is."

The medical excimer ruled it a homicide, as we've discussed. See below:

Under New York Penal Law §125.00, homicide is defined as “conduct which causes the death of a person . . . under circumstances constituting murder, manslaughter in the first degree, manslaughter in the second degree, criminally negligent homicide, abortion in the first degree or self-abortion in the first degree.

The medical examiner told you how this person died, but we can't even get an indictment in any of the above charges.

I'm also trying to find anything on tec's idea of a "single presentment" here and I can't.

It's not true.

I think Ferguson kinda told us how it works.   DA doesn't think he can get a conviction.    Officer is not indicted.

Same thing happens in NY.

Pretty much end of story.   Except for the libs complaining that there should have been a trial because they interpret the law differently.

Ok. Explain how the law, as written, does not apply to this man.

You're basically arguing that laws don't apply to law enforcement.
It's not that they don't apply, it's that they're is a lot more gray.   Because, you know, when they're trying to arrest a criminal, things aren't so black and white.  No pun intended.

This case seems very black and white. It's on video.

Garner wasn't aggressive. Garner didn't attack the police or cause them to fear for their lives. Pantaleo used an illegal method of restraining Garner, causing Garner's death.

It's not "my idea".  Nor have I confirmed that everything (or anything) my friend said in his post is correct.  I just threw it out there for what it's worth.

If he's got it all wrong, then so be it.

If I can't change it, yeah, pretty much.  I got a seatbelt ticket a year ago.  I don't like the law so I seldom wore one.  I was endangering myself.   And I haven't been in an accident in 30 years.   So, my "risk" was next to nothing.    Did I go fight the ticket just to be heard?  Or did I go pay the damn thing?    I know I didn't come argue about it on a simsports message board.

We have a judicial system in place.   A cop performing his duties may be forced to do some unpleasant things.    If he wasn't way "out of line" while doing his job, he's not going to be charged.   That's how it is.

FWIW, there were a lot of people standing around Garner.    Should they be charged?   I'm sure they saw the same thing as the cop who choked him.

But he was out of line.

I have clients that are federal judges that have presided over high profile cases. I have clients that are county judges, both civil and criminal.

What they all will tell you is the justice system works great most of the time but no one ever hears about that. People only ever hear about the few times it didn't work well and then make their judgments of the judicial system based on that.

Just because they tell you they are judges when they pay the dollar for the peep show, doesn't mean they are actually judges.

That's true in all walks of life.

We deliver a thousand loads on time.   A driver is late on the next one.   We're the worst trucking company in the world.
A lineman performs 70 blocks properly in a game.   He's **** because on play 71 he gives up a sack.
You give financial advice to 10000 people.   You **** up with one.  You're the sorriest financial advisor ever.
BL cooks a million burgers to perfection.    He undercooks the next one.   They snatch the paper hat of his head before he cooks another.

Yep.

I only bring that up for reference because BL is talking about the entire judicial system like its totally broken because of a few instances. I wonder how many of those people that 'FEEL' the system is rigged in ferguson or NYC actually understand how the judicial system works. My guess is very few. Attys and judges go to school for so many years to understand it.

A few instances?

The evidence of racism in the justice system is overwhelming.
