You're not understanding the ham sandwich saying. Because a DA could indict a ham sandwich if he wanted to, anytime he doesn't get an indictment, it's because he didn't want an indictment, not because he couldn't get an indictment.

Completely different standards for federal hate crime prosecution. Holder would have had to prove intent. The DA doesn't need intent.
