The medical examiner said he died of homicide, using NYS's definition. A grand jury said he didn't. Who is wrong? 
The ME is not part of the justice system.  The grand jury is.

Perhaps the ME doesn't know the meaning of homicide.

"the deliberate and unlawful killing of one person by another"
Yea, he should have googled "definition of homicide" rather than use the definition the NYS judicial system uses.

Right. The answer to your question is "No, not everyone being arrested gives an excuse on why they can't be treated the way they are at that moment."

I might let up a touch on his ******* neck. And if he tries to fight back, I'll do something about it. Garner resisted arrest, but he never gave any indication that he was a threat to a police officer.
You'd be a dead cop. Probably a good thing you are not in law enforcement.

That seems incredibly unlikely in this situation.

The cop was. 

You don't "let up a touch" when you're physically trying to take someone down.   You want them down.

A body is found in a trash bin. The ME determines he died of homicide. Is the question "are we sure he died of homicide" or is it "who did it?"

Imagine we find the person who did it on video. Clear as day. Can you imagine a scenario where this person ISNT EVEN INDICTED?

Cops deal with liars, cheaters, theives, murderers, rapists, etc, etc, every day.    Not a whole lot of them are truthful.
